Regulation Update – Minister of Law and Human Rights Regulation Number 34 of 2021 on Issuance of Visa and Stay Permit during the Handling Period of Corona Virus Disease 2019 Outbreak and National Economy Recovery (MoLHR 34/2021)

Previously, the Government of Indonesia issued the Regulation of the Minister for Law and Human Rights of the Republic of Indonesia Number 27 the Year 2021 regarding Restriction of Access for foreign nationals to Indonesian territory during the emergency Enforcement of Restriction on Public Activities (MoLHR 27/2021).

With the issuance of the new MoLHR 34/2021, the previous MoLHR 27/2021 is revoked and no longer valid.

I. The Content of Regulation

a. Holder of visa or stay permit which is still valid can enter Indonesia through some immigration checkpoint after fulfilled the health protocol. The mentioned visa or stay permit includes:

  • Service visa;
  • Diplomatic visa;
  • Visit visa;
  • Temporary stay visa;
  • Official residence permit;
  • Diplomatic stay permit;
  • Temporary stay permit; and
  • Permanent stay permit.

b. Other than the above visa/stay permit, transport ship crew entered Indonesia with their ship, holder of APEC Business travel card, and traditional border crosser can enter Indonesia.

c. The person in charge of the transport vehicle from outside of Indonesia is responsible for making sure every passenger brought negative RT-PCR COVID-19 test result, which is still valid, and the proof has received the complete dose of COVID-19 vaccine, except for of the yacht’s crew and foreigner under 12 years old.

d. The Minister temporarily suspend the issuance of a free visas and visas on arrival.

e. The Minister has the right to prohibit travel from countries with a high rate of COVID- 19 outspread.

f. Visit visa and temporary stay visa application are submitted together with:

  • Proof has received the complete dose of COVID-19 vaccine;
  • Statement letter of willingness to comply with every health protocol in Indonesia;
  • Proof of health/travel insurance which covers medical fee, and/or statement letter of willingness to pay for their own medical fee in the event of COVID-19 infection during their stay in Indonesia.

g. Foreigners with stay permits in Indonesia and currently unable to return to their own country can be granted a new stay permit after by acquiring a visit visa or temporary stay visa and then report to the immigration office in their domicile no longer than 7 (seven) days.

This MoLHR comes into force on 15th September 2021.
